🇯🇵　🇮🇹イタリア・ミラノでの新たな挑戦、美容室サロンとのコラボレーション。

準備を進める中で、私が最も大切にしていることの一つが
**「責任の境界線を引くこと」**です。⚖️
華やかな美容の世界ですが、独立してプロとして歩む以上、避けては通れないのが**「万が一のトラブル」への備え**。

今回は、私が実際の契約書に盛り込んだ
**「技術的責任の区分」**について、専門家としての視点をシェアします。💼
1. 「エステティシャンの責任」と「サロンの責任」を分ける理由
イタリアでは特に、口約束で済ませてしまい、後でトラブルになるケースが多くあります。
だからこそ、この点は非常に重要だと感じ、契約書に明記しました。✍️
フリーランスエステティシャンは、サロンに雇用されているわけではなく、対等なビジネスパートナーです。
だからこそ、
「どこまでが自分のミスで、どこからが施設の責任か」
を明確にする必要があります。
私は契約書に、責任の所在を以下のように切り分ける項目を追加しました。
✔ 技術的なミス（施術過誤）：エステティシャンの責任
✔ 設備・環境・製品の不備：サロンの責任
2. なぜ「環境」と「製品」の免責が必要なのか？ 🛡️
例えば…
▫️サロンが用意したマッサージベッドが故障し、お客様が怪我をした場合
▫️サロンが選定した化粧品（今回の場合は日本製品）で、予期せぬ反応が起きた場合
これらは、エステティシャンの技術の良し悪しとは関係のない場所で起こるリスクです。
ここを曖昧にしておくと、トラブルが起きた際に、すべての責任を個人が背負わされてしまう可能性があります。
私は契約書に次の一文を入れました。
「サロンの設備や環境に起因する損害について、エステティシャンは完全に免責される」
この一文は、自分のキャリアと身を守るための
**“最強の盾”**になります。🛡️✨

3. プロ同士の「信頼」は「明確さ」から生まれる 🤝
「こんな細かいことを言ったら、サロン側に嫌われないかしら？」
そう不安に思う方もいるかもしれません。
でも、現実は逆です。
リスクの所在をはっきり主張することは、
「自分の仕事の範囲を正確に理解しており、不測の事態にもプロとして論理的に対処できる」
という証明になります。
イタリアのビジネスシーンにおいても、こうした明確な線引きは、お互いの信頼関係をより強固なものにしてくれます。🇮🇹

As I prepare for this new chapter, one of the things I value most is drawing clear boundaries of responsibility. ⚖️
The beauty world may appear glamorous, but when you work independently as a professional, one thing you cannot avoid is preparing for unexpected risks and disputes.
Today I’d like to share, from a professional perspective, a clause I included in my actual contract regarding the allocation of technical liability. 💼

1. Why it is important to distinguish between the Aesthetician’s responsibility and the Salon’s responsibility
In Italy especially, many things are often left as verbal agreements, which can later lead to misunderstandings or disputes.
That is exactly why I felt it was essential to put this in writing. ✍️
As a freelance aesthetician, I am not an employee of the salon — I am an equal business partner.
For that reason, it is necessary to define clearly:
What falls under my professional responsibility, and what falls under the responsibility of the facility.
I added the following division of responsibility into my contract:
✔ Technical mistakes (treatment malpractice): Responsibility of the Aesthetician
✔ Equipment, environmental or product-related defects: Responsibility of the Salon

2. Why liability exemption regarding “environment” and “products” is essential 🛡️
For example:
▫️ If a massage bed provided by the salon fails and a client is injured
▫️ If a cosmetic product selected by the salon (in this case, Japanese products) causes an unexpected reaction
These are risks that arise independently from the quality of the practitioner’s technique.
If this remains vague, there is a real risk that all responsibility may unfairly be shifted onto the individual practitioner.
That is why I included this clause:
“The Aesthetician shall be held fully harmless from any damages arising from the Salon’s facilities, environment, or related conditions.”
This single sentence can become the strongest shield protecting both your career and yourself. 🛡️✨

3. Trust between professionals is built through clarity 🤝
Some may wonder:
“If I raise these kinds of detailed points, will the salon dislike it?”
In reality, the opposite is true.
Being explicit about risk allocation demonstrates that:
You understand the precise scope of your work and can respond to unforeseen circumstances with professional logic and responsibility.
Even in the Italian business environment, this kind of clarity strengthens mutual trust. 🇮🇹
